CARB to Amend Advanced Clean Fleets Regulation and Support Hydrogen Infrastructure

The California Air Resources Board (CARB) is moving forward with proposed amendments to the Advanced Clean Fleets (ACF) regulation. These changes would remove requirements for drayage, high-priority, and federal fleets. The proposal is scheduled for consideration at the September 25th Board Meeting. Public comment is open through September 15th.

This action stems from a legal settlement with a coalition of 17 states and industry groups, including the California Trucking Association, who challenged CARB’s authority to enforce these provisions without a federal waiver. As part of the settlement, CARB agreed to initiate this formal repeal process.

Staff’s proposal also includes updates to implement AB 1594 (Garcia, 2023), which provides greater operational and compliance flexibility under the ACF for public agency utilities. The State and Local Government fleet requirements under ACF remain enforceable, as they do not require a federal waiver. Additional changes are also proposed for the Low Carbon Fuel Standard (LCFS) to strengthen credit support for hydrogen fueling stations.
